Judge who ruled to switch off boy’s life-support ‘failed to carry out comprehensive evaluation’

A JUDGE who ruled doctors could turn off a 12-year-old boy’s life support made mistakes, a lawyer for his family told an appeal hearing.

Edward Devereux QC yesterday argued Mr Justice Hayden had not given “proper weight” to Archie Battersbee’s wishes and religious beliefs.

He added the judge failed to carry out a “comprehensive evaluation” of his treatment.

Archie has not regained consciousness since being found at his home in Southend, Essex, in April.

He is thought to have been taking part in a social media challenge.

Last week the High Court agreed with doctors at the Royal London ­Hospital that further treatment was “futile”.

Mr Hayden delivered a ruling last week and described what happened to Archie as a "tragedy of immeasurable dimensions".

The hearing at the Court of Appeal continues.
